Member Supplementary Terms & Conditions


Effective Date: 25/03/2026   Supplemental to Fitness Passport Membership Terms


These Supplementary Terms supplement your existing Fitness Passport Membership Agreement (Standard Terms). By opting into the Wellness App Pilot, you agree to these Supplementary Terms in addition to your Standard Terms. In the event of any conflict, these Supplementary Terms prevail in relation to the Pilot only. Capitalised terms not otherwise defined here have the meaning given in the Standard Terms.


1.   Definitions

1.1  In these Supplementary Terms, the following definitions apply:

Member means a Primary Member or, where applicable, a Secondary Member under the relevant Membership.

Membership means a current Fitness Passport Primary Member subscription.

Partner means a third-party wellness application provider whose app is included in the Pilot bundle.

Partner App means a wellness application provided by a Partner and made accessible to the Member through the Pilot.

Pilot means the Wellness App Pilot program described in these Supplementary Terms.

Pilot Period means the 12-month period commencing from the date the Member’s Pilot fee increase commences.

Redemption Code means the unique single-use access code issued by FP to the Member to activate a Partner App subscription.

Standard Terms means the Fitness Passport Primary Member Terms & Conditions (and, where applicable, Secondary Member Terms & Conditions) as in force from time to time.

Starter Bundle / Power Bundle means the bundle tier selected by the Member at the time of opting into the Pilot, as described in clause 3.1.


2.   Pilot Overview

2.1  The Pilot is a limited trial program designed to evaluate member engagement and the viability of offering wellness apps as part of the Fitness Passport membership. Participation is voluntary and continuation beyond the Pilot Period is not guaranteed.

2.2  The Pilot provides eligible Members with access to a curated bundle of Partner Apps through the issuance of Redemption Codes.

2.3  Availability is limited. FP reserves the right to close the Pilot offer once capacity is reached.


3.   Fees and Billing

3.1  Pilot Fee Increase

3.1  By opting into the Pilot, your existing Membership fee will increase by the following amount per fortnight, depending on the bundle selected:

3.2  The fee increase will be added to your next billing cycle following confirmation of your upgrade. If you opt in on the same day as your scheduled billing date, the fee increase will apply to the billing cycle after next.

3.2  12-Month Commitment

3.3  By opting into the Pilot, you commit to the increased Membership fee for the full Pilot Period of 12 months from the date your fee increase commences.

3.4  This 12-month commitment is separate from and in addition to any existing term obligations under your Standard Terms.

3.5  At the end of the Pilot Period, your Membership fee will automatically revert to your standard Fitness Passport rate (without the Pilot fee increase), unless FP notifies you otherwise.

3.3  Non-Refundable Fees

3.6  Once you confirm your Pilot upgrade, the fee increase is non-refundable, except where required by law.

3.7  Unredeemed or expired Redemption Codes do not entitle you to a refund or fee adjustment.


4.   Redemption Codes

4.1  FP will issue Redemption Codes to you within 24 hours of your upgrade confirmation.

4.2  Some Redemption Codes provide access to 12-month Partner App subscriptions; others provide 6-month subscriptions. The subscription duration for each Partner App is specified in the app profile you receive.

4.3  Redemption Codes expire on the date specified in the app profile for each Partner App. FP recommends redeeming each code within 30 days of receipt. Unredeemed codes are voided at expiry with no compensation, extension, or refund. It is your responsibility to redeem codes promptly and before the expiry date applicable to each Partner App.

4.4  Redemption Codes are issued to you personally and must only be redeemed using the account details associated with your Fitness Passport membership. Codes are non-transferable and for your personal use only. You must not share, sell, or transfer Redemption Codes to any other person.

4.5  FP reserves the right to void Redemption Codes and/or terminate your participation in the Pilot if FP reasonably believes codes have been shared or transferred.


5.   Partner Apps and FP’s Role

5.1  FP funds your access to Partner Apps but does not provide, operate, or control the Partner Apps. Partner Apps are provided by independent third-party Partners.

5.2  Upon redeeming a Redemption Code, you enter into a direct relationship with the relevant Partner, governed by that Partner’s own terms of service, privacy policy, and acceptable use policies. You should review each Partner’s terms and privacy policy before creating an account or using their app.

5.3  To the maximum extent permitted by law, FP is not responsible or liable for:

  1. Partner App availability, performance, functionality, or uptime;
  2. the accuracy, quality, safety, or appropriateness of Partner App content;
  3. changes, updates, or discontinuation of Partner Apps or their features;
  4. any disputes between you and a Partner, including billing, technical support, or content issues; or
  5. any loss, injury, or damage arising from your use of a Partner App.

5.4  For issues relating to a Partner App, you must contact the Partner directly using the support channels specified in the app profile.

5.2  Partner Substitution

5.5  FP reserves the right to substitute a Partner App if a Partner relationship ends during the Pilot Period. FP will use reasonable endeavours to provide a comparable alternative and notify you promptly. If FP is unable to provide a comparable substitute Partner App within 30 days of removal, affected Members may, upon written request to wellness-trial@fitnesspassport.com.au, receive a pro-rata fee reduction reflecting the removed app’s share of the bundle fee for the remaining period of unavailability.

5.3  Existing Subscribers

5.6  If you already hold a paid subscription to a Partner App, you may not be able to apply your Redemption Code to that existing subscription. Whether a code can be applied is at the sole discretion of the Partner.

5.7  FP will provide guidance on each Partner’s policy regarding existing subscribers in the redemption instructions you receive. However, FP does not control Partner policies and cannot guarantee any particular outcome.

5.8  No compensation, refund, or fee adjustment is provided if a Redemption Code cannot be applied due to an existing subscription.


6.   Data and Privacy

6.1  FP does not receive your login credentials, account details, or personal data from Partner Apps. Partners validate Redemption Codes only.

6.2  Any personal information you provide directly to a Partner is governed by that Partner’s privacy policy, not FP’s Privacy Policy. You should review each Partner’s privacy policy before creating an account or providing personal information.

6.3  FP’s collection, use, and disclosure of your personal information in connection with the Pilot remains subject to FP’s Privacy Policy, available at https://www.fitnesspassport.com.au/privacy-policy/


7.   Cancellation and Termination

7.1  Cancellation by You

7.1  You may cancel your participation in the Pilot at any time by contacting FP at wellness-trial@fitnesspassport.com.au.

7.2  If you cancel before the end of the Pilot Period, you remain liable for the fee increase for the full 12-month Pilot Period, except where you are entitled to cancel under your Standard Terms due to circumstances such as relocation, medical hardship, or employment termination.

7.3  If you cancel after the Pilot Period, your Membership fee will revert to your standard rate from the next billing cycle.

7.4  Cancellation of your Pilot participation does not affect any Partner App subscriptions you have already activated. You must cancel those directly with the relevant Partner.

7.2  Termination by FP

7.5  FP may terminate your participation in the Pilot immediately if you breach these Supplementary Terms, including (without limitation) if you share or transfer Redemption Codes. In such case, you remain liable for the fee increase for the full 12-month Pilot Period, and any unredeemed Redemption Codes will be voided with no refund.

7.6  If FP discontinues the Pilot for reasons other than your breach, clause 8 applies.


8.   Pilot Program Provisions

8.1  The Pilot is a trial program offered during the Pilot Period. The Member acknowledges and agrees that:

  1. the Pilot, including the bundle contents and Partner App availability, may be modified during the Pilot Period based on Member feedback, Partner availability, and FP’s operational requirements;
  2. FP may discontinue the Pilot at any time during or after the Pilot Period by providing not less than 30 days’ written notice to Members enrolled in the Pilot; and
  3. if FP discontinues the Pilot, affected Members may elect, within 14 days of receiving notice of discontinuation, to either: (i) continue their Membership at the standard Membership fee with no cancellation fee; or (ii) cancel their Membership in its entirety with no cancellation fee and no further liability.

8.2  If FP discontinues the Pilot during a Member’s Pilot Period:

  1. the Member’s fee will revert to the applicable standard Membership fee from the next direct debit cycle;
  2. if the Member does not make an election under clause 8.1(c) within 14 days, they will be deemed to have elected to continue their Membership at the standard rate; and
  3. any unredeemed Redemption Codes will be voided and, where the Member has paid a Pilot fee in advance for a period after the discontinuation date, FP will provide a pro-rata refund of that amount.

8.3  FP reserves the right to modify the bundle contents, pricing, or these Supplementary Terms at any time with not less than 30 days’ prior written notice to affected Members. If modifications materially reduce your benefits or increase your obligations, you may cancel your Pilot participation in accordance with clause 7.1 without liability for the remainder of the Pilot Period fee.

8.4  Following the expiry of the Pilot Period, FP may in its discretion:

  1. make the Pilot offering permanently available (with or without modifications to these Supplementary Terms);
  2. extend the Pilot Period for a further period to be determined by FP; or
  3. discontinue the Pilot in accordance with clauses 8.1 and 8.2.

8.5  The Pilot is available to a limited number of Members. FP reserves the right to close the offer at any time once capacity is reached.

8.6  FP may, in its absolute discretion, offer Members the opportunity to exit the Pilot early, receive fee adjustments, or participate in product feedback or research programs. Any such offer is made as a goodwill gesture at FP’s sole discretion, does not create a contractual right or entitlement on the part of any Member, and does not affect FP’s rights under these Supplementary Terms.


9.   Warranties and Liability

9.1  To the maximum extent permitted by law, FP makes no warranties or representations regarding:

  1. the availability, performance, functionality, or fitness for purpose of any Partner App;
  2. the accuracy, completeness, or reliability of Partner App content;
  3. the compatibility of Partner Apps with your devices or operating systems; or
  4. any health, fitness, or wellness outcomes you may or may not achieve through use of Partner Apps.

9.2  To the maximum extent permitted by law, FP’s total liability to you in connection with the Pilot (whether in contract, tort, statute, or otherwise) is limited to the total amount of Pilot fees paid by you to FP in the 12 months preceding the event giving rise to liability.

9.3  Nothing in these Supplementary Terms limits or excludes FP’s liability for fraud, wilful misconduct, death or personal injury caused by FP’s negligence, or any other liability that cannot be excluded or limited under applicable law, including your rights under the Australian Consumer Law.


10.   General

10.1  These Supplementary Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

10.2  These Supplementary Terms, together with your Standard Terms and FP’s Privacy Policy, constitute the entire agreement between you and FP in relation to the Pilot.
